Leisure World General Terms and Conditions of Use – All Sites 

  • Customers must comply with all the terms and conditions of use, area specific rules, bookings and cancellation policies (available on our website).
  • All products/services must be paid for in advance, unless other specific rules apply.
  • Leisure World reserves the right to change or cancel the programme sessions/facilities without prior notice where necessary.
  • Leisure World reserves the right to offer promotions to new bookings only without notice and will not offer any discount or promotion to existing bookings.
  • Leisure World reserves the right to close facilities for any reason if we deem it necessary.
  • Leisure World reserves the right to refuse custom, for any reason, if we deem it necessary.
  • Leisure World reserves the right to remove/ban anyone from our premises, for any reason, if we deem it necessary.
  • Leisure World reserves the right to change or cancel any offers or schemes without notice.

General Rules

  1. All members are required to book in and obtain a ticket at the kiosks or the main desk before going through the turnstiles at Leisure World Colchester. Failure to do so may result in the space being re-sold.
  2. My Leisure Cards or tickets must be scanned at the turnstiles for all Aerobics classes attended.
  3. Activa Workout tickets must be handed to the staff at the reception desk in the Gym.
  4. Members must stop at Aqua Springs reception and show their my Leisure Card before going through to the facility.
  5. Leisure World reserves the right to refuse entry to members who do not present their cards and tickets on every visit.
  6. Members must comply with all the Centre conditions of use, and full terms and conditions of Lifestyles (available on our website), failure to comply may result in forfeiting all membership rights.
  7. All members must agree to have their photograph taken which will be stored on the Leisure World leisure management system. The photo will be taken at the time of purchase for new members purchasing in-person; however, any memberships purchased online or members without photographs on the system will be required to have a photograph taken to update our records when requested by the Leisure World staff.
  8. Leisure World reserves the right to cancel or refuse a membership to any customers who do not agree to have their photograph taken and held on our system.
  9. All members are responsible for the security of their my Leisure Card and if the card is lost or stolen this must be reported to Leisure World.
  10. Leisure World will not be held responsible for any losses incurred by members due to lost or stolen my Leisure Cards.
  11. A fee of £3.50 will be charged for the replacement of lost my Leisure cards.
  12. my Leisure Cards are not refundable or transferable and if it is found that a third party is using a members card the membership will be suspended immediately pending investigation which may result in the membership being cancelled.
  13. Lifestyles 7 Day, 1 Month and 3 Month memberships can not be frozen or cancelled.
  14. Lifestyles memberships cannot be transferred.
  15. Membership applications are subject to approval. We reserve the right to refuse an application for a Lifestyles membership.
  16. The minimum age for an adult membership is 16.
  17. The maximum age for a junior membership is up to a persons 16.
  18. Entry to sessions and activities covered by your membership are subject to availability and queuing systems may operate at peak times.
  19. Facility usage may be restricted during certain sessions in the programme, for example for ladies only, people with disabilities, 50+ and other age/ability related activities.
  20. Leisure World reserves the right to change or cancel the programme sessions/facilities without prior notice where necessary. Discounts cannot and will not be given on membership fees on such occasions.
  21. Car parking is free to all members, but only whilst they are using the Centre. To qualify for free parking, car registration details will need to be entered into the iPads in the centre. Parking cannot be guaranteed at peak times.
  22. Promotions will not be pre-advertised and refunds or credits cannot and will not be given retrospectively on any existing memberships.
  23. Customers wishing to take out Corporate, Joint, Student and Freedom memberships will be required to show eligibility upon joining the scheme and from time to time when requested by Leisure World. This would not normally be more frequently than every 6 months.  Proof of eligibility varies according to membership type as per below, and may be subject to change from time to time:
    1. Corporate – proof of employer such as in date staff card, current payslip.
    2. Joint – proof of same address of both members such as utility bills, driving licences.
    3. Student – On presentation of: valid and in date NUS card, University or College ID card, proof of Full Time study for the current academic year.
    4. Freedom – proof of low income as shown on the Concession Application form and displayed on our website or proof of serving military / military veteran status or proof of Student status as above.

Booking Rules / Use of Membership

  1. Once a membership has been purchased whether in-person at Leisure World Colchester or online each individual member is responsible for making use of their Lifestyle Membership and utilizing the facilities and activities that are included within the subscription.
  2. Refunds will not be made solely on the grounds of unused memberships or any elements of the membership which are unused. See point 5. Refunds below.
  3. Bookings for sessions can be made up to seven days in advance.
  4. Full payment must be made for any activities not included in the membership option prior to play/activity.
  5. 48 hour cancellation notice must be given for all booked sessions. Cancellations with less notice will incur the full charge if the session is not resold.
  6. Non-attendance for booked courts or sessions will result in the full charge for the session being made and payable before any further bookings can be made or sessions attended.
  7. Session times must be observed during peak periods for all memberships, which include the Leisure Pool. You must return to the Welcome Zone in order to wait for entry to further sessions.
  8. Access from pools to Aqua Springs is not permitted through the link corridor whilst in wet swim wear.
  9. Use of the pools is only permitted during public swim sessions.
  10. Where Squash and Badminton are included in the membership package, a maximum of 2 racket courts (one at a time) may be used per day where applicable. Racket hire is available for a charge.
  11. It is compulsory for all Activa users to have been through an induction prior to using the gym. Inductions are charged separately and this payment is not included in your membership.
  12. Freedom concession memberships are only valid for use:
  13. Aqua Springs from 9am to 4pm Monday to Friday and 10am to 2pm Saturday and Sunday.
  14. All other activities included in the membership can be used at anytime except after 5pm Monday to Friday.
  15. Leisure World reserves the right to refuse or cancel a member’s membership where it is deemed that the member is sub-letting facilities or providing personal training.
  16. Leisure World reserves the right to levy a charge to members for other persons/non-members playing with/against them on the same court if there are more than 2 players per booked session for Badminton and more than 2 players per booked session for Squash.

Premier Membership 

  1. You can book 2 hours of badminton or 90 minutes of Squash per day.
  2. All Badminton courts have a maximum of 4 players and Squash Courts have a maximum of 2 players. Any courts with more than the stated number of player will be subject to  a charge of £1.50 per person.
  3. The membership holder must be playing on the court at time of booking. If they are not the customers playing will be charged the full rate of the court.
  4. 48-hour cancellation notice must be given for all booked sessions. Cancellations with less notice will incur the full charge if the session is not resold.
  5. Non-attendance for booked courts or sessions will result in the full charge for the session being made and payable before any further bookings can be made or sessions attended.
  6. Leisure World reserves the right to refuse or cancel a member’s membership where it is found and/or deemed that the member is sub-letting facilities.

Tennis Membership

    1. You can book 2 hours of consecutive Tennis on one day
    2.  All Tennis Courts have a maximum of 4 players
    3. The membership holder must be playing on the court at time of booking. If they are not the customers playing will be charged the full rate of the court.
    4. 48-hour cancellation notice must be given for all booked sessions. Cancellations with less notice will incur the full charge if the session is not resold.
    5. Non-attendance for booked courts or sessions will result in the full charge for the session being made and payable before any further bookings can be made or sessions attended.
    6. Leisure World reserves the right to refuse or cancel a member’s membership where it is found and/or deemed that the member is sub-letting facilities.

Payments (for Direct Debits also see Lifestyles Membership Terms & Conditions Contract and/or Lifestyles Membership Terms & Conditions Non-Contract Memberships as applicable)

  1. All membership fees whether by Direct Debit with an initial payment at the time of purchase or a one-off payment are all made in advance.
  2. Membership charges are reviewed from time to time and may be subject to an annual price increase. If paying by Direct Debit you will be sent written notice of changes to your payment in accordance with the Direct Debit guarantee.
  3. Direct Debit payments will be collected from the Bank Account authorised by the customer at the time of purchase on or just after the 1st of each month and these payments will commence as notified at the time of purchase whether this was in-person at Leisure World Colchester and as per your Direct Debit confirmation email/letter or when purchased online and as per the email confirmation of the Direct Debit instruction being set up.
  4. Leisure World cannot be held responsible for correspondence not received or lost in the post.
  5. Failure to make the monthly Direct Debit payment will result in a charge of £20 default administration charge being levied and your memberships being suspended until payment of the default fee and missed/failed payment has been received.
  6. If Direct Debit payments repeatedly fail Leisure World reserves the right to withdraw or cancel a membership on the Direct Debit scheme.
  7. Leisure World cannot be held responsible for cancelled memberships or failed payments due to errors made by the member’s bank.

Refunds (for Direct Debits also see Lifestyles Membership Terms & Conditions Contract and/or Lifestyles Membership Terms & Conditions Non-Contract Memberships as applicable)

Refunds are not available for any membership type on the Lifestyles Scheme, with the exception of:

  1. the 7 day money back guarantee period which applies only to the Fitness and Health & Fitness Annual or Direct Debit Non-Contract Memberships – memberships purchased more than 7 days previously will not be refunded. The 7 day money back guarantee only applies to new members who have not held a membership for Leisure World within the last 12 months.  In order to exercise this right, notification of cancellation within the 7 day period must be received in writing, which can be by email, by Leisure World from the member wishing to cancel their membership and to receive a refund.
  2. distance selling rules apply to memberships purchased online. This entitles the customer to cancel the membership and receive a refund within 14 days of purchase.  7 day, 1 Month and 3 Month memberships can not be purchased online.  Memberships purchased more than 14 days previously will not be refunded.  In order to exercise this right, notification of cancellation within the 14 day period must be received in writing, which can be by email, by Leisure World from the member wishing to cancel their membership and to receive a refund.

Cancelling a Direct Debit membership (also see Lifestyles Membership Terms & Conditions Contract and/or Lifestyles Membership Terms & Conditions Non-Contract Memberships as applicable)

  1. You have the right to cancel the agreement for your non-contract Direct Debit at any time by giving Harlands no less than 30 days notice prior to your next payment date either by email: c.service@harlandsgroup.co.uk, or by telephone to Harlands Services Ltd on: 01444 449 166 or in writing to: Harlands Services Ltd, 2nd Floor Rockwood House, 9 – 17 Perrymount Road, Haywards Heath RH16 3TW
  2. For contract memberships where a minimum of 12 monthly payments are due memberships can only be cancelled as per conditions set out in the Lifestyle Membership Terms & Conditions – Contract.
  3. 7 Day, 1 Month and 3 Month memberships cannot be frozen or paused and will expire 7 Days, 1 month or 3 months from the date of purchase or renewal as applicable.
  4. Leisure World cannot be held responsible for correspondence not received.
  5. If we are informed by your bank that the Direct Debit arrangement has been cancelled or if the Direct Debit has failed without the due notice being given a default administration charge of £20 will be levied and your membership will be suspended and cannot be used until alternative payment is made. Restarting your membership will also be subject to a further £20 joining fee.
  6. Leisure World will not refund members for any Direct Debit payments taken where the member has failed to follow the cancellation processes detailed in the full terms & conditions.

The Direct Debit Guarantee

All memberships paid by Direct Debit are covered by The Direct Debit Guarantee as per below:

 

  • This Guarantee is offered by all banks and building societies that accept instructions to pay Direct Debits
  • If there are any changes to the amount, date or frequency of your Direct Debit Colchester City Council t/a Leisure World Colchester will notify you 5 working days in advance of your account being debited or as otherwise agreed.
  • If you request Colchester City Council t/a Leisure World Colchester to collect a payment, confirmation of the amount and date will be given to you at the time of the request
  • If an error is made in the payment of your Direct Debit, by Colchester City Council t/a Leisure World Colchester or your bank or building society, you are entitled to a full and immediate refund of the amount paid from your bank or building society
  • If you receive a refund you are not entitled to, you must pay it back when Colchester City Council t/a Leisure World Colchester asks you to
  • You can cancel a Direct Debit at any time by simply contacting your bank or building society. Written confirmation may be required. Please also notify us.

Freezing a Direct Debit Membership (also see Lifestyles Membership Terms & Conditions Contract and/or Lifestyles Membership Terms & Conditions Non-Contract Memberships as applicable)

  1. Non-contract Direct Debit memberships can be frozen for periods of one, two, three, four, five or six whole months up to a maximum total freeze period of six months in any one calendar year at no charge.   Please note: Joint memberships can only be frozen together – we are unable to freeze individual joint members.
  2. For contract memberships where a minimum of 12 monthly payments are due memberships can only be frozen as per the full terms and conditions of the Lifestyle Membership Terms & Conditions Contract).
  3. We require 14 days’ notice in writing to activate a freeze. The freeze will take effect on the first day of the next calendar month providing the 14 days’ notice has been given.  Where written notice is less than 14 days until the first of the month, the freeze cannot begin until the first day of the following calendar month i.e. the next full month will be charged.  Freezes from specific dates are not possible.
  4. Do not cancel your Direct Debit instruction if you wish to freeze your membership as this will be regarded by us as a cancellation. We will not collect direct debit payments from your account during the freeze period, but will automatically start to collect payments from your account once the freeze period finishes.  If you cancel your direct debit you will be charged the £20 joining fee to re-activate it.
  5. After the freeze period the Direct Debit will automatically re-start, therefore it is the responsibility of the member to cancel their Direct Debit instruction and notify Leisure World of this cancellation if they no longer want to hold their membership as per the normal cancellation terms and conditions detailed in section 6. Cancelling a Direct Debit Membership.
  6. Leisure World will not refund members for any Direct Debit payments taken where the member has failed to cancel their membership with us and cancel their Direct Debit instruction.

Pausing an Annual Membership

  1. Annual memberships can be paused for a period of one, two, three, four, five or six whole months up to a maximum total pause period of six months in any one year. Please note: Joint Memberships can only be paused together – we are unable to pause individual joint members.
  2. We will activate this pause within 14 days of the pause being requested in writing and we reserve the right to apply the pause for whole months from the date of the pause being activated by us. If you have a specific date you want the pause to commence a minimum of 14 days’ notice must be given.

Making Changes to a Membership

  1. If you wish to Upgrade/ Downgrade your membership (dependant on what type of membership you hold) you may do so by completing an Upgrade/Downgrade form which is available from the Welcome Zone main desk at Leisure World Colchester.
  2. We require a minimum of 14 days’ notice in writing to activate an Upgrade or Downgrade. The change will take effect on the first day of the next calendar month providing the 14 days’ notice has been given.  Where written notice is less than 14 days until the first of the month, the change cannot begin until the first day of the following calendar month.  Changes from specific dates are not possible.
  3. If you wish to add or remove one member of a Joint Direct Debit Membership (dependant on what type of membership you hold) you may do so by completing a Joint to Sole or Sole to Joint membership form which is available from the Welcome Zone main desk at Leisure World Colchester.
  4. We require a minimum of 14 days’ notice in writing to activate an addition of a Joint Direct Debit Member. The change will take effect on the first day of the next calendar month providing the 14 days’ notice has been given.  Where written notice is less than 14 days until the first of the month, the change cannot begin until the first day of the following calendar month.  Changes from specific dates are not possible.
  5. We require 30 days’ notice in writing to remove a Joint Direct Debit Member. This is because a removal is a cancellation and cancellation terms apply.  The change will take effect on the first day of the next calendar month providing the 30 days’ notice has been given.  Where written notice is less than 30 days until the first of the month, the change cannot begin until the first day of the following calendar month.  Changes from specific dates are not possible.

LIFESTYLE MEMBERSHIP TERMS & CONDITIONS – CONTRACT

PRINCIPLE TERMS

1. This agreement is an agreement between you the member, Colchester City Council/Leisure World Colchester (“the Club”) and Harlands Services Ltd (“Harlands”). This agreement commences once you have indicated your acceptance in the Declaration section of this web sign up process. If you did not sign up on the club’s premises you have 14 full days after signup to cancel this agreement for any reason. To exercise this right you must inform Harlands or the club of this by post, email or telephone using the details above. You can use the cancellation form on page 2 of this document but it is not obligatory. If you exercise this right to cancel we will reimburse you all joining and membership fee payments received from you using the same means of payment you used for the initial transaction. If you have used the service before requesting to cancel then we will reduce your membership fee refund by a pro rata amount equal to the number of days from signup to the date cancellation was requested.

2. Your membership starts immediately.

3. You will be entitled to all the rights and privileges exercisable for the Type of Membership chosen, subject to your timely payment of the fees and charges set out below and the successful processing of your direct debit instruction.

4. Harlands provides direct debit payment services to you and administers our agreement with you, in consideration for which you agree to pay all the fees and charges associated with your Membership and set out below to Harlands.

FEES AND CHARGES

5. The Joining Fee / Initial Payment is due and payable immediately on execution of the agreement and is not refundable other than in the event ofbreach or negligence by us or on the valid exercise of your statutory cancellation rights, as set out in the Principle Terms above.

6. Your obligations to Harlands include payment of the Direct Debit Payment Amount. You are obligated to make the “Minimum No. of Direct Debit Payments” stated with the first one being paid on the 1st Direct Debit Payment Date and then every month thereafter. You are obligated to make every Direct Debit Payment regardless of non attendance, except where the Agreement is cancelled in accordance with the cancellation terms below or under your statutory cancellation rights, as set out in the Principle Terms above.

7. If you fail to pay any monies due under this agreement or if any Direct Debit is returned unpaid or any cheque is returned unpaid or if any other form of payment is not honoured for whatever reason, you shall pay Harlands on demand (i) an initial administration fee of £20; and (ii) any and all further reasonable costs incurred by Harlands in recovering the due fees and charges from you, including costs in tracing you if you have changed your address without telling us. Harlands’ right to recover these fees and costs shall be in addition to and without limitation of our rights or those of Harlands which may exist notwithstanding the terms of our Agreement.

8. You agree to advise us promptly of any change to the Members Details provided.

9. If you fail to pay any amount due under this agreement for a period of more than thirty days, then we or Harlands may pass the debt to a third party company for collection. In addition to any costs and charges Harlands may be entitled to under clause 7, the reasonable and direct costs incurred in employing the third party company will be borne by you, including costs in tracing you if you have changed your address without telling us.

AUTOMATIC RENEWAL

10. Once you have completed the Minimum No. of Direct Debit Payments we will automatically continue collecting the Direct Debit Payment Amount every month. Your membership will be extended by one month for each payment (“Renewal Period”). This renewal Direct Debit payment amount may only be amended if we advise you in writing in accordance with Direct Debit Guarantee. Please note if your membership included the benefit of a free period then we will stop making collections during that free period and recommence making collections on the renewal date.

11. You may prevent the Automatic Renewal at any time by giving notice to Harlands via our Helpline 01444 449 166 (you should give us not less than 30 days notice prior to your next payment date). When the final minimum period payment has been taken you should also cancel your Direct Debit mandate directly with your bank.

12. Once you have completed the Minimum Number of Direct Debit payments you can cancel your Automatic Renewal payments by contacting our Helpline (you should give us not less than 30 days notice prior to your next payment date). After the final payment has been taken you should also cancel your Direct Debit mandate directly with your bank.

CANCELLATION

13. Relocation: This agreement can be cancelled in the event that your new permanent address is more than 15 miles away from the facility upon receipt of a copy utility bill or bank statement showing the new address.

14. Long term (over 3 month) illness or injury: This agreement may be cancelled in the event of an illness, injury or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for 3 months or longer upon appropriate proof being provided.

15. Redundancy: This agreement can be cancelled upon appropriate proof of redundancy from your employer or other loss of livelihood.

16. Pregnancy: This agreement can be cancelled if you become pregnant upon the appropriate written proof being given.
Please note – ANY Cancellation for the above reasons will not be effected until the appropriate proof is provided and received (in writing or via email) by Harlands or the Club.

17. Breach: This agreement can be cancelled if we are in breach of contract including if we do not provide facilities or services you may reasonably expect and we have fallen well below that standard.

FREEZING

18. Temporary Illness or Injury: This agreement may be frozen in the event of a temporary illness, injury or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for a period of time.
Please note – ANY Freeze will not be effected until the appropriate proof is provided and received (in writing or via email) by Harlands or the Club. Please note – A freeze period does not affect the Minimum No. of Direct Debit Payments you are due to make and any payments remaining at the time of the freeze will remain due and recommence on a monthly basis once the freeze period has completed.

GENERAL TERMS

19. You agree to comply with the Lifestyle Membership Rules & Condition of Use which are displayed on our website: www.colchesterleisureworld.co.uk and the rules displayed in the Club which relate to opening hours, use of facilities and your conduct. We may make reasonable changes to these Rules at any time provided we give you reasonable advance notice of the change.

20. If we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.

21. We may assign the benefit of this agreement and our rights thereunder to a third party on notice to you. Your rights under this agreement will not be prejudiced. You may transfer your membership to another person provided that such person pay a Joining Fee signs an agreement with us and accepts the balance of any remaining Minimum No. of Direct Debit Payments.
22. We will do our best to resolve any disputes over this agreement. If you wish to take court proceedings against us you must do so within the United Kingdom. Relevant UK law will apply.

23. If any part of this agreement is disallowed or found to be ineffective by any court or regulator, the other provisions shall continue to apply.

24. We may terminate this agreement with immediate effect on notice to you if you are in breach of the Clubs Rules (i.e. Stealing or other criminal activities within the facility). In this event you will not be liable to pay any further Direct Debit Payments, provided such breach is not deemed by us to have occurred primarily in order to qualify you for a refund.

4. Harlands provides direct debit payment services to you and administers our agreement with you, in consideration for which you agree to pay all the fees and charges associated with your Membership and set out below to Harlands.

FEES AND CHARGES

5. The Joining Fee / Initial Payment is due and payable immediately on execution of the agreement and is not refundable other than in the event of breach or negligence by us or on the valid exercise of your statutory cancellation rights, as set out in the Principle Terms above.

6. Your obligations to Harlands include payment of the Direct Debit Payment Amount due on the 1st Direct Debit payment date and on the 1st of each month thereafter regardless of non-attendance, except where the Agreement is cancelled in accordance with the cancellation terms below or under your statutory cancellation rights, as set out in the Principle Terms above.

7. If you fail to pay any monies due under this agreement or if any Direct Debit is returned unpaid or any cheque is returned unpaid or if any other form of payment is not honoured for whatever reason, you shall pay Harlands on demand (i) an initial administration fee of £20; and (ii) any and all further reasonable costs incurred by Harlands in recovering the due fees and charges from you, including costs in tracing you if you have changed your address without telling us. Harlands’ right to recover these fees and costs shall be in addition to and without limitation of our rights or those of Harlands which may exist notwithstanding the terms of our Agreement.

8. You agree to advise us promptly of any change to the Members Details provided.

9. If you fail to pay any amount due under this agreement for a period of more than thirty days, then we or Harlands may pass the debt to a third party company for collection. In addition to any costs and charges Harlands may be entitled to under clause 7, the reasonable and direct costs incurred in employing the third party company will be borne by you, including costs in tracing you if you have changed your address without telling us.

AUTOMATIC RENEWAL
10. Your Direct Debit Payments will automatically continue collecting the Direct Debit Payment Amount every month. Your membership will be extended by one month for each payment (“Renewal Period”). This renewal Direct Debit payment amount may only be amended if we advise you in writing in accordance with the Direct Debit Guarantee.

11. You may prevent the Automatic Renewal at any time by giving notice to Harlands via our Helpline 01444 449 166 (you should give us not less than 30 days notice prior to your next payment date.). When the final payment has been taken you should also cancel your Direct Debit mandate directly with your bank.

CANCELLATION
12. You have the right to cancel this agreement at any time giving Harlands no less than 30 days notice prior to your next payment date.

FREEZING

13. You have the right to freeze membership payments for one, two, three, four, five or six whole months up to a maximum total freeze period of six months in any one calendar year at no charge. Please note: Joint memberships can only be frozen together – we are unable to freeze individual joint members.

14. You are required to give a minimum of 14 days’ notice in writing to activate a freeze. The freeze will take effect on the first day of the next calendar month providing the 14 days’ notice has been given. Where written notice is less than 14 days until the first of the month, the freeze cannot begin until the first day of the following calendar month i.e. the next full month will be charged. Freezes from specific dates are not possible.

15. Do not cancel your Direct Debit instruction if you wish to freeze your membership as this will be regarded by us as a cancellation. Direct Debit payments will not be collected from your account during the freeze period, but we will automatically start to collect payments from your account once the freeze period finishes.

16. If you cancel your direct debit you will be charged the £20 joining fee to re-activate it.

17. After the freeze period the Direct Debit will automatically re-start, therefore it your responsibility to cancel your Direct Debit instruction and notify Harlands of this cancellation if you no longer want to hold your membership as per the normal cancellation terms and conditions detailed in section 12. Cancellation above.

18. Refunds will not be given for any Direct Debit payments taken where you have failed to cancel your membership with us.

GENERAL TERMS

19. You agree to comply with the Lifestyle Membership Rules & Condition of Use which are displayed on our website: www.colchesterleisureworld.co.uk and the rules displayed in the Club which relate to opening hours, use of facilities and your conduct. We may make reasonable changes to these Rules at any time provided we give you reasonable advance notice of the change.

20. If we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.

21. We may assign the benefit of this agreement and our rights thereunder to a third party on notice to you. Your rights under this agreement will not be prejudiced.

22. We will do our best to resolve any disputes over this agreement. If you wish to take court proceedings against us you must do so within the United Kingdom. Relevant UK law will apply.

23. If any part of this agreement is disallowed or found to be ineffective by any court or regulator, the other provisions shall continue to apply

24. We may terminate this agreement with immediate effect on notice to you if you are in breach of the Clubs Rules (i.e. Stealing or other criminal activities within the facility). In this event you will not be liable to pay any further Direct Debit Payments, provided such breach is not deemed by us to have occurred primarily in order to qualify you for a refund.

The following shows what will be required as proof of eligibility for Freedom concession membership or a concession Leisure Card.

Students (age 16+) in full-time education – On presentation of: valid and in date NUS card, University or College ID card, proof of Full Time study for the current academic year. ID / letter to be shown at time of initial sign up and will not be required again until the following academic year.
Serving Military personnel & Military Veterans – Military or Veteran ID card must be shown.

The above criteria is subject to change at any time and it may mean that you are no longer eligible for a concession Leisure Card or Freedom membership. Teen Fit under the age of 16 years must have a completed Par-Q form before access to any fitness regime can take place.

Teen Fit aged 13 years or over can access the gym facilities. Users must be accompanied or supervised by an parents or guardian. Where applicable the Gyms do offer both supervised and unsupervised session, supervised will be carried out by our permanent Personal Trainer only at Leisure World Colchester Mon to Friday between 4-6pm and 8am-7pm on weekends. During unsupervised session will require children attending the gym to be accompanied by their Parents and/or Guardian (18 years or over) on ratio 2:1.

Teen Fit users under the age of 16 will not be allowed to use any Free Weight equipment on their own unless accompanied or supervised by a Parent/Guardian. Instead, we do encourage and promote the use of bodyweight and fixed resistance machine’s which are the safest and most effective forms of exercise for this specific group of users.

Teen Fit are permitted to use:

  • Resistance/Fixed Machines
  • Cardiovascular Machines (i.e. Treadmill, Bike, Cross Trainer and Rower)
  • Access to Functional Training Area

However NOT permitted to use (unless supervised):

  • Any Free Weight equipment such as Dumbbells, Barbells, using the Squat Rack/Platforms

At all times, whilst using the gym facilities it is the responsibility of the Parent/Guardian to ensure that any 13 to 15 year olds under their supervision, adhere to the rules and regulations to ensure the safety of themselves and others.

  1. This voucher cannot be exchanged for cash.
  2. Vouchers will not be refunded.
  3. This voucher may be exchanged for goods of a higher value on payment of the difference.
  4. Change to the value of £10 or more will be given in vouchers.
  5. Leisure World, Colchester Sports Park and Aqua Springs Spa reserves the right not to accept damaged or defaced

Who can have a My Leisure Card?

Everyone can apply for a My Leisure Card. There are three levels:

  • adult My Leisure Card

Does My Leisure Card cost anything?

No, My Leisure Card is free of charge.
How do I apply for My Leisure Card?

The easiest way to apply is on-line by clicking on the “Click to sign up” image above right.   Parents/guardians applying for a junior My Leisure Card must complete a separate application for each child.

If you qualify for a concession My Leisure Card, you should apply online for an adult My Leisure Card, then bring proof of eligibility to Leisure World Colchester so a member of staff can transfer you to the concession category.

You can apply at Leisure World Colchester in person, but this might take longer, especially at busier times.

How do I know if I am eligible for a concession My Leisure Card?

My children are enrolled on a course, what do I need to do?

All children currently enrolled on any courses at any of the sites will be automatically and can pick up their My Leisure Card from the Welcome Zone reception at Leisure World Colchester. If you register for My Leisure Card when you come with them, staff will activate your card to give you access at their lesson times.
I am a customer of more than one Leisure World site, do I need a different My Leisure Card for each site?

No, you only need one My Leisure Card.
I am a member of a club which hires Leisure World Colchester, how will I get through the turnstiles?

To attend a club you will need to ask a Welcome Zone staff member to issue you with ticket to scan at the turnstiles.
I have booked a squash or badminton court, how will the person I am playing with get through turnstiles?

When the person you are playing with arrives at Leisure World Colchester, they will need to go to the Welcome Zone main desk and confirm the booking details. They will then be given a ticket to scan at the turnstile.
What if I forget to bring my card to Leisure World Colchester?

You will need to either go to the Welcome Zone main desk and identify yourself or to a self-service kiosk and enter your identification and pass code to get a ticket to scan at the turnstile.
Can I sign up to the scheme but not have a card?

Yes, you can sign-up to the scheme without ever taking a card; however, this will mean that you will be unable to use the fast-track entry through the turnstiles at Leisure World Colchester. If you are signing up to only use another site, such as Leisure World Tiptree, you are still more than welcome to have a card, but this site will not have turnstiles for fast-track entry.
Is there an alternative to the credit card size card?

Yes, if you would prefer to have a key fob instead of the card this will cost £1 and this will work in the same way as the card at the turnstiles.
What happens if my My Leisure Card is lost or stolen?

If your My Leisure Card is lost or stolen you can pay for another one to be issued. These will be charged at £3.50 for both credit card size cards and key fobs.
What if my My Leisure Card is broken or worn out?

If you return your broken or worn out card or key fob it will be replaced, like- for-like, free of charge.
What happens if I change my address or other contact details?

It is a condition of the use of the card that you update us if your details change and in order to make the most of My Leisure Card you need to keep us up to date so that you don’t miss out on offers and rewards.

In addition to points 1-7 below:

  • All public sessions are laned and speed graded to improve your swim experience.
  • We offer our customers a poolside access hoist at all times.
  • No outdoor footwear is permitted in the Fitness Pool village change.
  • A swim etiquette information flyer is available at reception.

The following applies to all of our Swimming Pools including Swimming Lessons, Sessions and Water Fitness Classes:

  1. The swimming pool prices listed are for public swim only. Please ask at our Reception for prices of special sessions.
  2. In all of our swimming pools, children under the age of 8 years must be accompanied in the water by an adult who is 16+ years.
  3. All children under the age of 8 years old must be accompanied in the water by an adult at all times, 1 adult : 2 children under the age of 8 years. A pool safety flyer is available at reception.
  4. Swimmers are asked to exit the Fitness Pool 5 minutes before the end of a public swim session to allow staff time to prepare and clean for the next booking.
  5. To allow for changeovers, classes and sessions may terminate 5 minutes before or after the advertised closing time.
  6. Times for the swimming pools, sessions and classes may be subject to change due to bank holidays and pool events. Please check our class amendments and swimming pool pages for any changes to timetables before your journey.
  7. At various times of the year we run customer and staff training courses which take place during public sessions in the Swimming Pools. This will restrict pool availability at certain times.
  8. General Pool rules are displayed in the building and are there for your health and safety and your enjoyment.

  • 48 hours cancellation notice must be given for all booked sessions.
  • You can also hire a range of sports equipment, including rackets, from our reception.
  • All bookings must finish as per your allocated activity slot.
  • Leisure World reserves the right to apply a surcharge to any users which go beyond their allocated booking.

In order to get the best out of our Group Fitness Classes…

  • Booking is advisable for all our classes.
  • Please ensure you arrive in time to complete the warm up section. The instructor may refuse admission to participants who arrive after this section is completed.
  • Classes may terminate a few minutes before the published time.
  • Participants must be 16 years old and over (except Zumba, Divacise, Box Fit, Line Dancing and all Water Aerobic classes which are suitable for 14 years plus.)
  • Anyone under 16 years must be accompanied by a parent or guardian also participating in same class.
  • Spectators are not permitted in our Group Fitness Classes.
  • All classes are subject to change.

Group Fitness Class Cancellation Policy

  1. If you book but do not attend a class and do not provide the required notice, we reserve the right to charge the full cost of the class.
  2. Notice periods: There must be a minimum of 2 hours’ notice given to cancel all Group Fitness Classes.
  3. Cancellations can be made via the online booking service or call Welcome Zone on 01206 282000.
  4. You must ensure you confirm your attendance for each class by collecting your ticket from the kiosk or Welcome Zone and scanning your ticket at the turnstiles.
  5. Please note there is a 48 hour cancellation policy on all non-member class bookings.

Lost property will be kept securely for 28 days from the date of loss.

Items not kept include:

  • Shampoo and shower gel
  • Under garments
  • Hairbrushes, combs or hair clips/bands
  • Water bottles

Items kept for 24 hours include:

  • Wet towels
  • Wet clothes
  • Goggles

If a Debit/Credit card is handed in we will contact the appropriate Bank/Building Society. If they advise us to, we will destroy the card.

The management of Leisure World cannot be held responsible for property that is left behind and subsequently stolen or lost.

In addition to your legal rights, we will also allow you to return goods if you change your mind providing the product(s) are in new and unworn/unused condition, all packaging is intact and any relevant hygiene labels are in place.

Please return the goods to us with the original till receipt within 14 days and we will offer you an exchange or refund.

Our Loyalty Points scheme closes on 1st April 2024. 

  • From 1st January 2024 points will no longer be awarded. 
  • On 1st April 2024 any unused points will have expired and will no longer be redeemable. 
  • You must be a my Leisure Card holder. 
  • Your my Leisure Card must be presented at the time of payment for a product or activity in order to accrue** or redeem loyalty points. **Excludes Leisure Pool and Inflatable swim sessions, Aqua Springs Beauty Therapy Treatments or products, block bookings and any invoiced items at any Leisure World centre, Courses/Lessons, Vending and Machines. 
  • Loyalty points are awarded to the my Leisure Card holder paying for the product or activity and are not transferable. 
  • 1 point will be awarded for each full £1.00 spent per activity or product (e.g. £4.10 = 4 points, £6.90 = 6 points). An incorrect award total may show on paper receipts. However the actual points awarded to your account and subsequent account balance will be correct. 
  • Lifestyles members will earn points on their membership payments. All up front payments will have points awarded at the time of purchase/payment. Direct Debit payments will have points awarded at the end of each month. 
  • Points for Kiosk and online transactions will be awarded the next day. 
  • The current conversion value of a loyalty point is £0.01p. 
  • Leisure World may set a limit on the number of times points may be awarded for promotional items or activities on which additional points are available. 
  • Loyalty points may only be redeemed on-premises transactions to the full value of an activity, course or product (e.g. 190 points can be redeemed for a £1.90 Coffee, 500 points can be redeemed for a £5.00 pair of Zoggs goggles). Payment for activities or items cannot be split between points and cash/cheque/credit or debit card. 
  • For online transactions (excl. swimming) loyalty points may be redeemed for full or part payment for an activity.  Payment for activities booked online can be split between points and credit or debit card. 
  • Loyalty points can only be redeemed by the member who is named and registered for the my Leisure Card. 
  • Any points not redeemed within two years will become invalid and cannot be used as payment for items or activities. 
  • Any changes to your personal details must be amended by you either through our website or speaking to a member of staff as per the my Leisure Card Terms & Conditions. Leisure World cannot be held responsible for any loss of points incurred as a result of out of date details. 
  • Leisure World cannot be held responsible for any loss of points as result of my Leisure cards being lost or stolen. 
  • Leisure World may decline to issue, withdraw or cancel Loyalty points, and / or remove a member from the scheme at any time where there is reasonable belief of: • any abuse or attempted abuse of the scheme • any breach or attempted breach of these terms and conditions • any behaviour relating to Leisure World that involves theft, misconduct, abusive or offensive behaviour, or supplying false or misleading information. 
  • The scheme is only for personal and consumer use and cannot be used for any business transaction or purpose. 
  • Leisure World reserves the right to change, add or remove products and activities included in the scheme at any time and without notice. 
  • Leisure World reserves the right to change or cancel the Loyalty points scheme without notice. 
  • Leisure World is entitled to remove points at any time if products are returned or activities/courses cancelled and a full or partial refund of the purchase price is given. 
  • Leisure World reserves the right to suspend or remove loyalty points scheme at times of system disruption/maintenance. 
  • Loyalty points have no cash redemption value. 

  • Reward is only applicable when a referred friend takes out individual Lifestyles membership, paying by monthly direct debit or one off annual payment.
  • 7 day, 1 month, Student, Freedom, Joint or Junior memberships do not qualify.
  • Referrals must be made using “Refer a Friend” card by a current Lifestyles member paying by monthly direct debit or one off annual payment.
  • Referred “friend” must present the “Refer a Friend” card at the time of joining and pay the joining fee.
  • To be eligible for the reward, both the referring and the referred member must remain live members for three months from the joining date of the referred member.
  • Three months from the joining date of the referred member:

In response to customer feedback Leisure World Colchester and the Northern Gateway Sports Park is implementing a cancellation policy for Group Fitness Classes.

Customers have told us that even when classes are fully booked spaces are available due to some members booking but not attending the class. By making a charge for ‘no shows’ we hope that more class spaces will be available to those who want to attend.

If you have booked but do not attend a class and do not provide the required notice you will be charged the full cost of the class.

Notice periods:

PRINCIPLE TERMS

This agreement is an agreement between you the Swimming Lesson Payer and Colchester City Council/Leisure World Colchester (“the Club”) This agreement commences once you have indicated your acceptance in the Declaration section of Swim Lesson enrolment sign up process.

If we are informed by your bank that the Direct Debit arrangement has been cancelled, your place on the lessons will be suspended and you or your children are no longer eligible to attend the swimming lessons under the scheme until alternative payment arrangements have been made. Additional fees and charges will apply as set out above.

If your Direct Debit fails we will contact you to inform you to arrange for payment by an alternative method and if necessary complete a new Direct Debit Mandate. Additional fees and charges will apply as set out above.

Failure to make alternative payment will ultimately mean that we cancel the place(s) on the Swimming Lesson Programme.

Swimming Lesson applications are subject to approval. We reserve the right to refuse an application for Swimming Lessons.

Minimum age for the payer of any Direct Debit is 16 years.

Refunds are not available on the Swimming Lesson scheme.

Non-attendance or missed weeks by the customer will not be subject to any refund.

The Centre Management reserves the right to change or cancel the programme sessions/facilities without prior notice where necessary.

Promotions will not be pre-advertised and refunds or credits cannot be given retrospectively for existing customers.

Once a swimmer is enrolled onto our Swimming Lesson programme it is the responsibility of the customer, or a parent/guardian if customer under 16 year of age, to ensure that any changes to medical history and/or medication or any other change of circumstance is reported in writing to Leisure World Colchester. (Change of details forms are available from Main Reception and will be available at future swimming enrolments for this purpose).

Leisure World Colchester reserves the right to withdraw the Swimming Lesson Direct Debit scheme at any time.

If your Direct Debit payment fails for any reason on 1st of the month, we will try to collect this again on 15th of the month, after this alternative payment will need to be made. Fees may apply see full terms and conditions of the scheme.

Failure to make alternative payment will ultimately mean that we cancel the place(s) on the Swimming Lesson programme.

What happens if I cancel my Direct Debit?

If we are informed by your bank that the Direct Debit arrangement has been cancelled, your place on the lessons will be cancelled from the end of your current payment period and you or your children will no longer eligible to attend the swimming lessons under the scheme.  Re-enrolment will be subject to available spaces and alternative payment arrangements being made. Fees may apply see full terms and conditions of the scheme.

Can I pay for more than one swimmer by Direct Debit?

Yes, you will need to register details of all of the swimmers you wish to pay for and this will be called as separate amounts. You will receive written confirmation of the Direct Debit reference, amount and schedule of payments for each swimmer.

Do I have to pay by Direct Debit or can I prepay for a block of lessons?

You are welcome to prepay for a block of 10, 15 or 20 lessons.  The Direct Debit scheme has been introduced to give you the option to spread your payments if you wish.

Direct Debit prices are based on 40 weeks of swimming lessons per year.  This means that whether you pay for lessons in prepayment blocks or by Direct Debit you will be paying exactly the same amount per lesson over the 40 weeks of lessons per year.
